Este artigo tem por finalidade abordar aspectos da legislação, em especial os relacionados à educação brasileira no que concerne à diversidade étnico-racial negra contemporânea e as políticas de ações afirmativas e seus impactos para as comunidades. O estudo parte de uma abordagem documental e bibliográfica e, à luz de obras de autores como Hasenbalg (2005), Munanga (2003), Rocha (2006), Silvério (2003), Carvalho (2006), Heringer (2014) e Marçal (2015), esses pesquisadores promovem o debate e a compreensão do cenário das reivindicações construídas ao longo da história pelos movimentos sociais, bem como seus conflitos, disputas, avanços e desafios em torno dos 10 anos das Ações Afirmativas. A perspectiva teórica que orienta o estudo, busca delinear a potencialidade das políticas de ações afirmativas que, segundo os pesquisadores, resultaram no surgimento de uma intelectualidade que contribuiu para uma nova compreensão do mundo social, consequência de uma produção teórica que impactou as ciências humanas e sociais, inclusive no Brasil.

This article aims to address aspects of the legislation, especially those related to Brazilian education with regard to black ethnic-racial diversity, from a contemporary historical time, and in the same way to state the policies of affirmative actions and their impacts on the communities. The study starts from a documental and bibliographic approach and in the light of works by authors such as Hasenbalg (2006), Munanga (2003), Rocha (2006), Silvério (2003), Carvalho (2006) and Marçal (2015) among others, promotes the debate and the understanding of the scenario of claims built throughout history by social movements, as well as their conflicts and disputes. The theoretical perspective that guides the study seeks to outline the potential of affirmative action policies which, according to the researchers, have resulted in the emergence of an intelligentsia that has contributed to a new understanding of the social world, the consequence of a theoretical production that has had an impact on the human and social sciences, including in Brazil.
