Na atualidade, é importante a discussão sobre liberdade e tolerância religiosa tendo em vista as divergências existentes nas diferentes sociedades, tornando-se necessário compreender a visão do Direito a partir das diferentes ideias de justiça. Diante disso, esta pesquisa teve por base a concepção de Michael Sandel a respeito da justiça, sendo que sua compreensão apresenta alternativas para se pensar a liberdade religiosa e se buscar uma maior tolerância. A pesquisa, bibliográfica, teve como método de abordagem o dedutivo e a perspectiva crítico-reflexiva da realidade e do conhecimento, e usou como referencial teórico a compreensão filosófica de justiça de Michael Sandel.

Currently, the discussion regarding religious freedom and tolerance is important, due to the disagreements about the subject in many different societies, making it necessary to comprehend how this reality is approached by the Law, most importantly the different ideas of justice. This research had as theme the analysis of religious freedom and tolerance based on the views of Michael Sandel regarding justice, since his comprehension presents an alternative to think about religious freedom and to increase tolerance. The research is bibliographic, developed with the deductive method and the critical-reflexive perspective of reality and knowledge, using as theoretical reference the philosophical comprehension of Michael Sandel.
