Este estudo tem por objeto o regime jurídico dos loteamentos a partir do estatuto constitucional da propriedade. Examinadas as regras constitucionais sobre o dever de cumprimento da função social, estudou-se a competência municipal para fixação do coeficiente de aproveitamento. O respeito ao coeficiente mínimo, regra geral, exige o parcelamento do solo por loteamento ou desmembramento. Examinou-se, então, o regramento jurídico da aprovação, do registro e do cancelamento de loteamentos urbanos. Estudou-se o princípio da conservação do loteamento e os efeitos dele decorrentes. Examinaram-se os loteamentos ilegais, clandestinos e irregulares, e a regularização fundiária. A partir da distinção entre concurso voluntário e afetação, discutiu-se a caracterização do concurso voluntário nos loteamentos ilegais.

The subject matter of this study is the legal regime applicable to land division plans in view of the provisions contained in the Brazilian Constitution on the ownership of real property. Upon examination of the constitutional rules that impose observance of the social function of property, one considered the competent jurisdiction of city governments to establish a specific ratio of use thereof. The minimum ratio stipulates that the division of land be made either through land division plans or through “dismemberment plans”. Hence, one examined not only the legal rules that apply to the approval, registration and cancellation of urban land division plans, but also the principle of preservation of a land division plan and the effects produced thereby. One has also analyzed illegal, unauthorized and irregular land division plans followed by further compliance therewith. Upon distinguishing between voluntary concurrence and appropriation, one discussed the characterization of voluntary concurrence in illegal land division plans.
