O presente artigo aborda a transformação da compreensão da norma jurídica no mundo contemporâneo diante das mudanças sociais, impulsionadas pelo processo de globalização e pelo fenômeno do culturalismo, que promove a integração social. O conceito de norma jurídica clássico, consolidado pelo Direito Internacional, é, atualmente, insuficiente para lidar com a aplicação de seu conteúdo, tendo em vista a complexidade das relações entre os indivíduos, e da própria evolução do Direito, que fez com que o intérprete da norma passasse a analisar o teor da lei antes de promovê-la, adequando-a ao caso concreto. Assim, pretende-se com este artigo compreender como as transformações desse mundo, pluricultural ou multicultural, influenciam no tradicional ius cogens presente na norma jurídica. Para tanto, a metodologia aplicada se fez mediante pesquisa e análise qualitativa bibliográfica dos autores apontados aprofundaremos na reflexão dos conceitos do culturalismo, buscando formular uma perspectiva do tema para nosso tempo atual, valendo-se da temática dos Direitos Humanos, e do embate teórico clássico entre Universalismo e Relativismo Cultural sob perspectiva multidisciplinar e considerando os impactos da Globalização sobre a matéria.
This article deals with the transformation of the understanding of the legal norm in the contemporary world in the face of social changes, driven by the process of globalization and by the phenomenon of culturalism, which promotes social integration. The concept of a classic legal norm, consolidated by international law, is currently insufficient to deal with the application of its content, given the complexity of relations between individuals, and the evolution of law, which made the interpreter of the norm began to analyze the content of the law before promoting it, adapting it to the concrete case. Thus, it is intended with this article to understand how the transformations of this world, pluricultural or multicultural, influence the traditional ius cogens present in the legal norm. In order to do so, the applied methodology was made through research and qualitative bibliographical analysis of the mentioned authors. We will deepen in the reflection of the concepts of culturalism, seeking to formulate a perspective of the theme for our current time, using the theme of Human Rights, and the classic theoretical between Universalism and Cultural Relativism under a multidisciplinary perspective and considering the impacts of Globalization on the matter.
