O trabalho tem por escopo discutir a natureza jurídica da responsabilidade administrativa ambiental segundo os precedentes do Superior Tribunal de Justiça. Observa-se que o Tribunal superou o seu entendimento anterior de que a responsabilidade administrativa ambiental teria natureza objetiva, passando a alinhar-se com a concepção de uma responsabilidade administrativa ambiental de natureza subjetiva. A partir desta constatação, este trabalho tem por objetivo analisar tal overruling, analisando os precedentes-chave que o marcaram e as razões que levaram o Tribunal a alterar seu entendimento sobre a questão.
Resumo Inglês:
This paper aims to study the juridical nature of the environmental administrative liability as to its understanding by Brazil´s Superior Court of Justice´s precedents. On the notice that the Court has overruled its preview understanding on the matter in order to align to the conception of the environmental administrative liability as of an subjective liability, this paper aims to study such overruling and the key precedents that stablished it, as such the reasons adopted by the Court on the matter.
