Este artigo tem por objetivo analisar o acesso à justiça das pessoas surdas na Bahia. O problema de pesquisa é a investigação do grau de efetividade do direito fundamental de acesso à justiça garantido pelo judiciário a comunidade surda baiana. Na investigação da problemática proposta, ergue-se o objetivo geral de demostrar que, embora possa existir acesso à Justiça (Judiciário) aos surdos, não existe o acesso à justiça que observe a equidade social. Os objetivos específicos para alcançar a meta geral estão alinhados com cada capítulo deste artigo e são os seguintes: no capítulo inicial, contextualizar as pessoas surdas como uma comunidade linguística própria e carente de atenção estatal; em seguida, expor as dificuldades da comunidade surda baiana para exercer o direito funda-mental de acesso à justiça e, finalmente, comprovar a existência de barreiras linguísticas estruturalmente impostas à comunidade surda baiana no exercício desse direito. A metodologia empregada utiliza o método dedutivo para aproximar-se ao do tema e envolve análise legislativa, levantamento de dados, pesquisa documental e revisão de literaturas bem referenciadas, tanto nacionais quanto internacionais, como artigos científicos, livros online e físicos. O tema mostra grande relevância acadêmica e prática devido à importância de garantir acessibilidade dos surdos à justiça, com respeito a suas particularidades. A pesquisa conclui que há falta de efetividade nas normas para o acesso à justiça das pessoas surdas e uma carência de políticas públicas direcionadas a esse grupo.
This article aims to analyze the access to justice of deaf people in Bahia. The research problem is the investigation of the degree of effectiveness of the fundamental right of access to justice guaranteed by the judiciary to the deaf community of Bahia. In the investigation of the proposed problem, the general objective is to demonstrate that, although there may be access to justice (Judiciary) for the deaf, there is no access to justice that observes social equity. The specific objectives to achieve the overall goal are aligned with each chapter of this article and are as follows: in the initial chapter, to contextualize deaf people as a linguistic community of their own and in need of state attention; then, to expose the difficulties of the Bahian deaf community to exercise the fundamental right of access to justice and, finally, to prove the existence of language barriers structurally imposed on the Bahian deaf community in the exercise of this right. The methodology used uses the deductive method to approach the theme and involves legislative analysis, data collection, documentary research and review of well-ref-erenced literature, both national and international, such as scientific articles, online and physical books. The theme shows great academic and practical relevance due to the importance of ensuring accessibility of the deaf to justice, with respect to their particularities. The research concludes that there is a lack of effectiveness in the norms for access to justice for deaf people and a lack of public policies aimed at this group.
