O presente artigo tem por objetivo abordar o tema dos direitos humanos em sua natureza polÃtica como o direito a ter direitos na filosofia polÃtica de Hannah Arendt, precisamente quanto aos direitos civis e polÃticos. Inicialmente o artigo retrata a ineficácia dos direitos humanos ante a crise polÃtica envolvendo a ausência de nacionalidade dos apátridas e refugiados no contexto fático-polÃtico da crise dos Estados-nação e das polÃticas totalitárias. Situação em que emerge a fragilidade dos fundamentos dos direitos humanos para atender homens em estado de necessidade. Ao criticar a incongruência das teorias fundacionais em garantir tais direitos, Arendt defende seu conceito de cidadania como o direito a ter direitos, atentando para a natureza polÃtica dos mesmos. Em seguida, o artigo, trata da liberdade como conceito polÃtico e não filosófico, por meio do qual a cidadania, como participação ativa dos cidadãos, pode ser exercida. Cidadania respaldada na liberdade de ação, que ao ultrapassar o vÃnculo da nacionalidade e da intitulação formal de direitos, possibilita a participação do cidadão na vida polÃtica da comunidade, permitindo, por essa via, a efetivação dos direitos
humanos.
The following article has the objective to discuss the human rights in its political nature such as the “right to have rights†in the political philosophy of Hannah Arendt, more specifically civil anda political rights. Firstly, the article portrays the inefficency of the human rights facing a political crisis envolving the abscence of nacionality of stateless and refugees in the factual-poltical context of the nation-state crisis and the totalitarian politics. In this situation emerges the fragility of the fundamentals of the human rights to support men in state of need. When criticizing the incongruency of the foundationals theories to ensure these rights, Arendt defends her concept of citizenship as the ‘right to have rights’, approaching more specifically the political nature of those rights. After that, the article, discuss freedom as a political, and not philosophycal, concept. With this political concept, citizenship, as the active participation of the citizens, can be exercised. Citizenship which is based in freedom of action, which exceeds the link between nacionality and the formal entitlement of rights. Once this link is exceeded, it is possible the citizens to participate in the political life of the community. This allows the human rights to be exercised.
