O presente texto tem por escopo produzir breve estudo acerca do problema da decisão judicial no modelo filosófico da autopoiese jurídica. Nele se busca uma reflexão sobre os limites das decisões em sua relação com o ambiente social. A decisão judicial é vislumbrada a partir do pensamento de Niklas Luhmann como emissão comunicativa que necessita apresentar aptidão da produção de ressonância nas estruturas dos subsistemas sociais em interconexões sistêmicas (acoplamentos estruturais) com o sistema jurídico. Perspectiva da consciência dos limites sistêmicos das decisões judiciais, tanto em seu aspecto eficacial quanto no da argumentação jurídica. A decisão dentro desse horizonte passa a ser problematizada como possibilidade de disfuncionalidade das prestações do sistema do direito na sociedade complexa e funcionalmente diferenciada.
The purpose of this text is to produce a brief study on the problem of judicial decisions in the philosophical model of legal autopoiesis. It seeks to reflect on the limits of decisions in their relationship with the social environment. Judicial decisions are seen from the perspective of Niklas Luhmann as a communicative emission that needs to present the ability to produce resonance in the structures of social subsystems in systemic interconnections (structural couplings) with the legal system. Perspective of awareness of the systemic limits of judicial decisions, both in their effectiveness and legal argumentation aspects. The decision within this horizon begins to be problematized as a possibility of dysfunctionality of the services of the legal system in a complex and functionally differentiated society.
