Novas perspectivas do direito à saúde no Brasil sob o olhar de O Direito Achado na Rua

O presente artigo intenta contextualizar brevemente a saúde pública no Brasil, a partir dos anos 1900 até a promulgação da Constituição Federal de 1988 e instituição do Sistema Único de Saúde (SUS), em 1990. A partir da análise histórica, foram delineados alguns dos enormes
desafios na permanência de políticas públicas voltadas para a saúde, em especial no contexto dos governos de orientação liberal. Em um cenário de supressão e diminuição de direitos sociais e da dificuldade de praticar o controle e a participação social, idealizar soluções sob novas
perspectivas de efetivar direitos, positivados ou não, é fundamental.

New perspectives on the right of health in Brazil under the outlook of ‘The Law Found on the Streets’
This article discusses some perspectives on the right of health and presents the Brazilian health system, since the begining of the 20th century until the promulgation of the current Constitution, in the year of 1988, and the creation of the Unified Health System (SUS), the national health service in 1990. From a historical perspective, some efforts and challenges to keep permanent health policies were outlined, especially in governments with liberal-minded orientation. In a scenario where social righst are being suppressed or decreased, and there are difficulties in exercising social control and participation, idealizing solutions under new perspectives, established or not in the legal system, is fundamental.
