Tem-se feito crescente a interveniência da função jurisdicional do Estado nas relações sociais, com inexpugnável tendência à judicialização do debate público, à judicialização de escolhas que tradicionalmente a democracia confiou aos órgãos constituídos da atividade estatal legiferante. Da Revolução Francesa à contemporaneidade, mormente a partir do contributo da experiência norte-americana, a autoridade dos tribunais tem assumido amplitude cada vez mais evidente, com caráter substitutivo de parcela do território das manifestações majoritárias, materializadas pelo labor daqueles que se legitimam no sufrágio direto do cidadão, daqueles que recebem do eleitor a outorga de poder para construir a norma jurídica.

It has been increasing the intervention of the courts of the State in social relations, with an unassailable tendency to legalization of public debate, the legalization of choices that democracy traditionally entrusted to the agencies composed of legislating state activi-ty. From the French Revolution to contemporary times, mainly from the contribution of the American experience, the authority of the courts has assumed increasingly amplitude evidence, with a substitution character of a portion of the territory of the majority manifestations, embodied by those who work in legitimate direct suffrage of the citizen, those who receive from the voter the empowerment to build the rule of Law.
