Este artigo tem o objetivo de apresentar as relações entre os usos do termo numerus clausus no debate sobre direitos fundamentais e como princípio da execução penal. Metodologicamente, o artigo parte de revisão bibliográfica, com pesquisa realizada por meio do método analítico-dedutivo, em especial, a partir das referências ao uso do termo pelo Tribunal Constitucional Federal Alemão na década de 1970. Com esta abordagem, inicia-se por meio da retomada do significado que numerus clausus carrega dentro do debate constitucional e sua interação com a teoria da “reserva do possível”. Em sequência, traça-se a origem do uso do numerus clausus na execução penal como alternativa à situação penitenciária e à falta de vagas que atinge o mínimo existencial e a dignidade da pessoa humana. Na seção posterior, aborda-se o reconhecimento do “estado de coisas inconstitucional” (ADPF 347) e a aplicação do numerus clausus no sistema socioeducativo como “estratégia de gestão” pelo Supremo Tribunal Federal. Diante da indeterminação do termo em razão dos usos como princípio, sistema, lógica e “estratégia de gestão”, propõe-se a utilização do numerus clausus como regra de direito fundamental, a partir da teoria de Robert Alexy. Ao final, recorre-se à conexão com a dignidade da pessoa humana, à manutenção do mínimo existencial e aos destinatários dos direitos fundamentais para pensar sobre a jusfundamentalidade do numerus clausus em face do estado de desconformidade constitucional ao qual as pessoas custodiadas pelo Estado brasileiro são submetidas.
This article aims to present the relationships between the uses of the term
numerus clausus
in the debate on fundamental rights and as a principle
of penal execution. Methodologically, the article is based on a literature
review, with research conducted using the analytical-deductive method,
focusing in particular on references to the use of the term by the German
Federal Constitutional Court in the 1970s. With this approach, it begins,
then, by resuming the meaning that
numerus clausus
carries within the
constitutional debate and its interaction with the “reservation of the
possible” theory. In sequence, the origin of the use of
numerus clausus
in
penal execution is traced, as an alternative to the penitentiary situation and
the lack of vacancies that affects the existential minimum and the dignity
of the human person. In the subsequent section, the recognition of the
“unconstitutional state of affairs” (ADPF 347) and the application of
numerus clausus
in the socio-educational system as a “management strategy”
by the Federal Supreme Court are discussed. Given the indeterminacy of
the term due to its uses as a principle, system, logic and “management
strategy”, it is proposed to use
numerus clausus
as a rule of fundamental
right, based on the theory of Robert Alexy. In conclusion, the connection
is made with the dignity of the human person, the maintenance of the
existential minimum, and the recipients of fundamental rights to consider
the jusfundamentality of
numerus clausus
in the face of the constitutional
nonconformity experienced by individuals in custody under the Brazilian
state.
