Resumo Português:

O presente estudo tem por objetivo identificar se é possível exigir do Poder Público políticas efetivas para garantir o direito à educação básica através da concretização do acesso à Internet durante o período de pandemia causada pela COVID-19. Para tanto, cabe abordar o Direito à Educação sob o prisma do mínimo existencial. Ademais, impende estudar a igualdade de acesso à educação sob o prisma material, que impõe ao administrador público o dever objetivo de atender aos ditames constitucionais. Sob o viés prático, cabe analisar a visão da Corte Constitucional quanto à salvaguarda dos direitos prestacionais, em especial da educação básica, além de se identificar políticas públicas concretas de acesso à Internet desenvolvidas durante a pandemia em benefício de alunos carentes. Considerando-se que o trabalho é de natureza bibliográfica, a abordagem foi feita através do método dedutivo, concluindo-se, ao final, pela viabilidade de se requerer ao Estado a garantia do acesso à Internet para a continuidade da educação básica e, se este for omisso, a postulação judicial.

The presente study search to identify whether it is possible to demand effective policies from the Government to guarantee the right to basic education through the materialization of Internet access during the pandemic period caused by COVID-19. Therefore, the Right to Education must be approached from the perspective of the existential minimum. In addition, it is important to study equal access to education from a material perspective, which imposes on the public administrator the objective duty to comply with constitutional dictates. From a practical point of view, it is necessary to analyze the Constitutional Court's view regarding the safeguarding of service rights, especially basic education, in addition to identifying concrete public policies for Internet access developed during the pandemic for the benefit of needy students. Considering that the work is bibliographic in nature, the method of approach used was the deductive method, concluding, in the end, by the feasibility of requiring the State to guarantee Internet access for the continuity of basic education and, if this is omitted, the judicial postulation.
