O presente trabalho tem por objetivo referenciar a moral e a liberdade segundo a filosofia de Immanuel Kant, implícitas na Lei 13.146/2015, Lei Brasileira de Inclusão da Pessoa com Deficiência. A importância dessa referência filosófica se dá pelo papel fundamental que o instituto abarca na proteção aos direitos fundamentais da pessoa humana, os quais são inalienáveis e irrenunciáveis e que toda a coletividade, em seu respeito e cumprimento, deve observar. A Lei 13.146, também conhecida como Estatuto da Pessoa com Deficiência (EPD) traz, além de uma imposição normativa, um importante instrumento de valorização à liberdade e à moral na relação com o outro.

The present work aims to refer to moral and freedom according to the philosophy of Immanuel Kant, implicit in the Law 13,146/2015, which establishes the Brazilian Law of Inclusion of Persons with Disabilities. The importance of this philosophical reference is due to the fundamental role that the Institute includes in the protection of the fundamental rights of the human person, which are inalienable and inalienable, and which the whole community, in its respect and compliance, must observe. Law 13,146, also known as the “Statute of the Person with Disabilities” (EPD) brings, in addition to a normative imposition, an important instrument for valuing freedom and morals in relation to the other.
