Este artigo apresenta a concepção de Maquiavel em sua obra O Príncipe, aplicada ao ativismo, demonstrando o interesse do Executivo na continuidade do ativismo judicial. Por meio de uma abordagem crítico-interpretativa, pretende- -se expor a negligência dos detentores de representatividade legislativa e executiva diante dos direitos fundamentais, os quais perpassaram um longo lapso temporal para serem reconhecidos e garantidos à sociedade. Indaga-se, também, a abrangência das políticas públicas, uma vez que o Executivo se utiliza da “bondade” do Judiciário para promovê-las para aqueles que se socorrem ao Judiciário e não para todos, como deveria ser. O objetivo deste trabalho é evidenciar a postura paradoxal do Executivo, a qual, ao mesmo tempo em que condena o ativismo, também o incentiva, por meio de ações e omissões. Assim, torna-se oportuna uma análise desses atos pela filosofia maquiavélica, e questionando: quais são os interesses do Executivo no ativismo judicial? Concluindo-se que a culpa do ativismo judicial não é exclusiva do Judiciário, devido ao incentivo dos demais poderes para a continuidade dessa prática. Porém, o Poder Judiciário deve se utilizar do ativismo excepcionalmente.

This article presents the Machiavelli’s conception in his work The Prince, applied to activism, showing the government’s interest in the continuity of judicial activism. By means of an approach critic-interpretative it is intended to expose the holders’ legislative and executive representativeness negligence in face of the Fundamental Rights, which have passed by a long time to be recognized and guaranteed to society. Also inquires, the public’s polices comprehensiveness, since the Executive uses the “goodness” of the Judiciary to promote these for those who rely on the Judiciary and not for all as it should be. The purpose of this paper is to highlight the Executive’s paradoxical stance, which at the same time condemns activism, is also encouraging by means of actions and omissions, and making it opportune an analysis of these acts by the Machiavellian philosophy, and questioning: what are the Executive’s interests in judicial activism? Concluding that the guilt of judicial activism is not exclusive to the Judiciary, due to the incentive of the other powers for its continuity, however, the Judiciary must be attentive and use of the activism exceptionally.
