O presente artigo possui por objetivo analisar as consequências jurídicas e socioeconômicas do congelamento social de óvulos, que decorre da escolha voluntária de uma mulher que, por razões interpessoais ou profissionais, congela os óvulos para uma eventual gravidez futura. Por isso, foram analisados o procedimento por meio do qual o congelamento de óvulos ocorre e o custo do procedimento no Brasil. Em seguida, foram exploradas as normas jurídicas e as decisões judiciais que possuem correlação com o congelamento de óvulos. Também foi realizada uma comparação com a realidade dos Estados e da Inglaterra, no que tange aos elementos destacados. A metodologia da pesquisa consistiu em um levantamento bibliográfico, o qual incluiu um exame normativo e um estudo comparativo entre países distintos. Os resultados alcançados denotaram que o congelamento social de óvulos representa uma perspectiva de avanço reprodutivo para diversas mulheres, mas o alto custo do procedimento constitui uma barreira financeira para as interessadas em congelar os óvulos, além de haver escassa regulamentação legislativa sobre a matéria.
The purpose of this article is to analyze the legal and socioeconomic consequences of the social egg freezing, which results from the voluntary choice of a woman who freezes her eggs for a future pregnancy, for personal or professional reasons. For this reason, the procedure by which egg freezing occurs and the cost of the procedure in Brazil were analyzed. Afterwards, the legal rules that regulate the social egg freezing were explored, as well as judicial decisions on the topic. A comparison between these elements and the reality of the States and England was also made. The research methodology consisted of a bibliographic survey, which included a normative examination and a comparative study between different countries. The results achieved showed that the social egg freezing represents a perspective of reproductive progress for several women, but its high cost is a financial barrier for those interested in egg freezing, in addition to the lack of legislation on the subject.
