O Novo Constitucionalismo Latino-Americano trata-se, recolhendo todo o histórico e evolução do Constitucionalismo desde a sua aparição – e em particular os avanços no constitucionalismo europeu depois da Segunda Guerra Mundial – do avanço em âmbitos nos quais o Constitucionalismo europeu não tratou: a democracia participativa, a vigência dos direitos sociais e dos demais direitos, a busca de um novo papel da sociedade no Estado e a integração das minorias até agora marginalizadas. O presente trabalho busca estudar o histórico do Constitucionalismo e as características desse novo movimento, trazendo as realidades latino-americanas nesse contexto, no anseio de entender em qual movimento o Brasil se insere.
Resumo Inglês:
The new Latin American Constitutionalism is, analyzing the historical and evolution of the constitutionalism since its appearance - and in particular the advances of the European post- war constitutionalism - the progress in spheres where the European constitutionalism did not address: the participative democracy, the social rights and other rights implementation, the search for a new role of the society in the State and the integration of the minorities so far marginalized. The present paper aims to study the constitutionalism history and the characteristics of this new movement, which brings the Latin American realities in this context, in the deep desire to understand in which movement Brazil belongs to.
