O artigo aborda o problema da ausência de conexidade entre as funções da responsabilidade civil e o valor arbitrado de dano moral. Analisam-se, para tanto, o princípio constitucional da obrigatoriedade da fundamentação das decisões judiciais no ordenamento jurídico brasileiro, os critérios utilizados para fixação dos danos morais e as funções da responsabilidade civil. A fim de ratificar o ponto aqui defendido, são colacionadas decisões de diversos tribunais nesse sentido.

The article addresses the problem of the lack of connection between the functions of civil liability and the arbitrated amount for moral damage. Therefore, the constitutional principle of the obli-gation to base judicial decisions in the Brazilian legal system, the criteria used to establish moral damages and the functions of civil liability are analyzed. In order to ratify the point that is being defended here, several final court decisions are collected in this regard.
