Este trabalho tem como propósito realizar uma breve análise sobre o CrÃton de Platão, resgatando, na figura de Sócrates, o problema da relação entre o homem e a cidade, o dever de submissão à s leis e o direito à desobediência. Serão abordadas ainda as relações de continuidade e descontinuidade que marcam a questão do dever de obediência no mundo antigo e na modernidade, sendo também confrontadas as formulações contidas no CrÃton e na Apologia de Sócrates com outras mais recentes acerca do dever de obediência à s leis, nomeadamente a contida na Teoria da Justiça de John Rawls. Ao final, tentar-se-á discutir a existência de critérios normativos que, em última instância, legitimam o dever de obediência ou a existência de um direito moral à desobediência.
This paper aims to make a brief analysis of the Crito of Plato, rescuing in the figure of Socrates, the problem of the relationship between man and the city, the duty to submit to the laws and the right to disobey them. We will address further the relationship of continuity and discontinuity that marks the question of the duty of obedience in the ancient world and in modernity, confronting, also, the formulations contained in the Crito and the
Apology on the duty of obedience to the laws with more recent ones, especially that one contained in the Theory of Justice of John Rawls. In the end, the paper tries to discuss the existence of some normative criteria that ultimately legitimate the duty of obedience or a moral right of disobedience to the law.
