Resumo Português:

O presente trabalho tem por objetivo analisar o direito à vida dos pacientes e a obtenção de tratamento para suas patologias pelas vias judiciais. O direito a medicamentos, muitos deles de alto custo, não são fornecidos pelo Sistema Único de Saúde – SUS. Ressalta-se que, uma das dificuldades de realizar o tratamento é conseguir o mesmo por via administrativa. Além disso, outro ponto negativo é a falta de cumprimento do Estado, mesmo com liminares em processos judicias. Com isso, surgiu o instituto da judicialização da saúde, que está sendo muito discutido tanto no Supremo Tribunal Federal (STF), como no Superior Tribunal de Justiça (STJ). Mesmo com alguns processos judiciais sendo provido em favor do paciente, o processo de compra e entrega do medicamento ainda é muito demorado, o que pode ocasionar piora e até morte do paciente. Necessita-se assim, de uma atuação mais célere do Estado na questão de saúde



Resumo Inglês:

The objective of this study is to analyze patients' right to life and obtain treatment for their pathologies through judicial channels. The right to medicines, many of them of high cost, are not provided by the Unified Health System – SUS. It is emphasized that, one of the difficulties of carrying out the treatment is to achieve the same by administrative means. In addition, another negative point is the lack of compliance of the Brazilian Government, even with injunctions in legal proceedings. With this, the institute of the judicialization of health arose, which is being much discussed by both the Brazilian Federal Supreme Court (STF) and the Brazilian Superior Court of Justice (STJ). Even with some legal proceedings being provided in favor of the patient, the process of purchase and delivery of the medication is still very time consuming, which can cause worsening and even death of patients. It is necessary, therefore, a more effective action of the Brazilian Government in this health issue.
