O artigo discute a inconstitucionalidade da penhora do bem de família do fiador à luz dos direitos humanos e da Teoria dos Direitos Fundamentais. Para fundamentar a tese defendida, o trabalho analisa a interpretação da legislação infraconstitucional em consonância com a Constituição e com o Direito Internacional dos Direitos Humanos, concluindo pela inconstitucionalidade.
Resumo Inglês:
The article discusses the unconstitutionality of the pledge of the guarantor's family property in the light of human rights and the Fundamental Rights Theory. In order to base the thesis defended, the paper analyzes the interpretation of the infraconstitutional legislation in consonance with the Constitution and with the International Law of the Human Rights, concluding by the unconstitutionality.
