Este artigo analisa o papel do Estado na efetividade do direito à moradia. Primeiramente, busca-se no ordenamento jurídico brasileiro parâmetros que definam o que é uma moradia digna. A resposta negativa leva à pesquisa em documentos internacionais, dos quais o Brasil é signatário. Estabelecido o parâmetro normativo, busca-se o conteúdo material desse direito com base na análise de casos já julgados pelo Supremo Tribunal Federal e pelo Superior Tribunal de Justiça. Por fim, é apresentado estudo sobre o déficit habitacional no Brasil entre os anos de 2007 a 2014.

This paper analyzes the role of the government in implementing the right to have a home. First, we sought rules in the Brazilian law that establish what is an adequate home. Since there is not a satisfactory answer, we looked for treaties and international rules in which Brazil has took part. Once determined the normative parameter, we intended to give the right to have a home a concrete meaning. We do so by analyzing cases judged by both Supreme and Superior Courts of Brazil. Finally, we present a study on the habitational deficit in Brazil between 2007 and 2014.
