RESUMO. O presente artigo visa a investigar em que medida o processo de globalização e o avanço tecnológico têm contribuído para a maximização dos fluxos migratórios hodiernos, impondo aos Estados a responsabilidade pelos direitos fundamentais e sociais da população estrangeira, destacando-se, o acesso à saúde. Busca-se compreender o alcance jurídico dos direitos fundamentais, para, em seguida, analisar a ordem constitucional brasileira, que demarca a saúde como um dever do Estado e direito de todos e, ainda, dá tratamento sistemático à matéria, enunciando os diversos princípios norteadores do sistema único de saúde. Posteriormente, aponta-se entraves que dificultam o acesso dos estrangeiros ao Sistema Único de Saúde, propondo-se, ao final, a fixação de alguns preceitos racionais hábeis a disciplinar a árdua tarefa de conviver com o diferente e garantir o acesso ao direito fundamental à saúde desse grupo minoritário.

ABSTRACT This article aims to investigate the extent to which the process of globalization and technological advances have contributed to the maximization of current migratory flows, imposing on the States the responsibility for the fundamental and social rights of the foreign population, with emphasis on access to health. It seeks to understand the legal scope of fundamental rights, and then to analyze the Brazilian constitutional order, which demarcates health as a duty of the State and right of all, and also gives systematic treatment to the matter, stating the various guiding principles Of the single health system. Subsequently, obstacles are identified that hinder foreigners' access to the Unified Health System, proposing, in the end, the establishment of some rational rational precepts to discipline the arduous task of living with the different and guaranteeing access to the fundamental right to health.
