O presente ensaio tem o propósito de guiar o estudante do direito constitucional em meio a um estudo estruturalista da matéria. Vale dizer, a organização do estudo do direito constitucional a partir das três fundações do neoconstitucionalismo, de forma que todas as temáticas estejam conectadas a uma dessas bases. Concebe-se, de antemão, que o direito constitucional, em sentido amplo, comportaria duas frentes: a teoria constitucional e o direito constitucional, no sentido lato. Esse, então, subdividir-se-ia em três grandes estruturas, as quais abarcariam todas as temáticas insertas nas Constituições contemporâneas: a separação de poderes, o equilíbrio entre os poderes e a garantia de direitos. Assim, por exemplo, o estudo da organização de cada um dos Poderes, o controle de constitucionalidade e os direitos fundamentais, correspondentemente. Este formato permite uma visão holística do direito constitucional e das Constituições. E mais do que isso, permite que o estudante compreenda a conexão do tema estudado com a respectiva base, ressaltando-se a sua natureza e a própria razão de ser de cada instituto.

The aim of this paper is intended to guide the student of constitutional law in the midst of a structuralist study of matter. That is to say, the organization of the study of constitutional law from the three foundations of neo-constitutionalism, so that all the themes are connected to one of these bases. It is conceived, in advance, that constitutional law, in a broad sense, would have two fronts: constitutional theory and constitutional law, in the broad sense. This, then, would subdivide into three great structures, which would cover all the themes inserted in the contemporary Constitutions: the separation of powers, the balance between the powers and the guarantee of rights. Thus, for example, the study of the organization of each of the Powers, the control of constitutionality and fundamental rights, correspondingly. This format allows a holistic view of constitutional law and the Constitutions. And more than that, it allows the student to understand the connection of the studied subject with the respective base, emphasizing its nature and the very reason of being of each institute.
