O direito de propriedade passa por modificações ao longo dos anos. O presente estudo traz uma breve análise de sua evolução, desde o Direito Romano até o Direito Contemporâneo, em tempos de pandemia. A CF/88 prevê a propriedade em duas acepções: como um direito fundamental e como fundamento da Ordem Econômica. A empresa, no exercício contemporâneo de suas atividades, deve observar princípios como o da solidariedade social, o da valorização do trabalho humano, cumprindo com sua função social. A aceleração do processo globalizatório e o advento da quarta revolução industrial trazem profundas mudanças na forma de organização empresarial surgindo, em consequência, novas formas de trabalho. O artigo busca analisar uma forma organizacional do século XXI: as empresas de plataformas digitais. Utiliza-se como modelo a empresa UBER, por ser precursora nessa forma organizacional, de rápida expansão a outros setores, ensejando o surgimento da categoria dos trabalhadores de aplicativos. Dentro da temática de Direitos Humanos e Empresas, analisa-se os desafios da proteção jurídica do trabalhador de plataformas digitais, como o tema vem sendo tratado em outros países e no Brasil e como compatibilizar as mudanças profundas da quarta revolução industrial com a garantia de direitos sociais conquistados ao longo da história. O tema mostra-se de relevante discussão, em especial, nesse momento de pandemia global, em que os referidos trabalhadores permanecem ainda mais vulneráveis. Utiliza-se, como método de pesquisa, a bibliográfica e a análise de julgados, objetivando trazer uma reflexão e amadurecimento acerca do tema.

The property right undergoes modifications over the years. This study provides a brief analysis of its evolution, from Roman Law to Contemporary Law, in times of pandemic. The CF/88 provides for ownership in two meanings: as a fundamental right and as the foundation of the Economic Order. The company, in the contemporary exercise of its activities, must observe principles such as social solidarity, the valorization of human work, fulfilling its social function. The acceleration of the globalization process and the advent of the fourth industrial revolution bring profound changes in the form of business organization, resulting in new forms of work. The article seeks to analyze an organizational form of the 21st century: digital platformcompanies. The UBER company can be used as a model, as it is a forerunner in this organizational form, which is rapidly expanding to other sectors, giving rise to the emergence of the category of application workers. Within the theme of Human Rights and Business, the challengesof legal protection of digital platform workers are analyzed, how the theme has been treated in other countries and in Brazil and how to reconcile the profound changes of the fourth industrial revolution with the guarantee of social rights conquered throughout history. The topic is of relevant discussion, especially at this time of global pandemic, in which the workers will remain even more vulnerable. It uses, as a research method, the bibliography and the analysis of judgments, aiming to bring a reflection and maturation about the theme.
