Lies have always existed in the world of politics, but the phenomenon known as fake news is a thornier obstacle to democracy in algorithmic societies. The present work analyzes the phenomenon of disinformation from a broader perspective of the damages caused in social networks, in view of the inevitable collision between the regulations imposed and freedom of expression. By summarizing the regulatory scenario and the complexity of regulating disruptive sectors, we contribute to the regulatory debate by expounding some interdisciplinary premises necessary for the regulation of freedom of expression in social networks, especially in Brazil.
Mentiras siempre existieron en el universo de laPolítica, pero el fenómeno mundialmente conocido como fake news representa un óbice más espinoso para la Democracia en las Sociedades Algorítmicas. En el presente trabajo pretendemos analizar el fenómeno de la desinformación en un campo más amplio de daños practicados em las redes sociales, con vistas a la colisión inevitable entre las regulaciones impuestas y la libertad de expresión. Sintetizándose el escenario regulatorio y la complejidad en regular sectores disruptivos con incertidumbres científicas, se objetiva una contribución al debate regulatorio, exponiendo algunas premisas interdisciplinarias necesarias para pensar la regulación de la libertad de expresión en las redes sociales, especialmente en Brasil.
