O presente estudo tem como objetivo apresentar o método genealógico nietzschiano como uma proposta de superação do clássico método positivista que ainda possui grande aplicabilidade no Direito brasileiro. O método genealógico permitirá analisar as bases históricas formadoras da ciência do Direito, para que se possa ser proposta uma reconstrução da ciência jurídica à luz de uma hermenêutica filosófica aplicada ao direito constitucional, em especial nos princípios constitucionais que irão sempre nortear toda e qualquer interpretação do Direito e assim permitir que se encontra a resposta constitucionalmente mais adequada.

This research aims to show the genealogical method by Nietzsche as a propose of overcoming of the classic positivism method, because this method still has important application in Brazilian Law.The genealogical method allows to analyze historical basis of science of Law, to propose a reconstruction of science of law. After that, it proposes to think the science of law using Philosophical hermeneutics applied of constitutional law, especially in the constitutional principles, because they will help every juridical interpretation and they will help to meet the right constitutional answer.
