O Programa de Controle Médico de Saúde Ocupacional é um dos instrumentos aptos a concretizar a qualidade de vida no trabalho mediante a prevenção de doenças no meio ambiente laboral que deve ser sadio e equilibrado. Ocorre que a Lei 14.289/2022 tornou obrigatória a preservação do sigilo sobre a condição de pessoa que vive com infecção pelos vírus da imunodeficiência humana (HIV) e das hepatites crônicas (HBV e HCV), com hanseníase e com tuberculose, vedando expressamente a sua divulgação nos serviços de saúde e locais de trabalho, o que se aplica ao médico do trabalho no exercício de sua profissão. Será averiguado se o direito ao sigilo garantido aos trabalhadores acometidos por tais enfermidades poderia dificultar a implementação do Programa de Controle Médico de Saúde Ocupacional ao limitar a atuação do médico do trabalho responsável e a divulgação do conteúdo dos prontuários médicos individuais.

The Occupational Health Medical Control Program is one of the instruments capable of achieving quality of life at work through the prevention of diseases in the work environment that must be healthy and balanced. It turns out that Law 14.289/2022 made it mandatory to preserve the confidentiality of the condition of a person living with infection by the human immunodeficiency virus (HIV) and chronic hepatitis (HBV and HCV), with leprosy and tuberculosis, expressly prohibiting the its dissemination in health services and workplaces, which applies to occupational physicians in the exercise of their profession. It will be investigated whether the right to confidentiality guaranteed to workers affected by such diseases could hinder the implementation of the Occupational Health Medical Control Program by limiting the work of the responsible occupational physician and the dissemination of the content of individual medical records.
