O SENTIDO DO DIREITO NA IDADE MÉDIA: FILOSOFIA DE BASE E EXPRESSÕES JURÍDICAS

O escopo do artigo é perscrutar a existência de linhas mestras
e de sentido especial nas diversas expressões ou modalidades de direito da
Idade Média. Há desafios especiais na
análise a serem superados: a inexistência de um sistema unÃvoco e homogêneo de direito nos moldes emergentes
no perÃodo moderno; a extensão do
que se convencionou chamar idade
média; a variedade de expressões jurÃdicas coexistentes em cada perÃodo
e a filosofia de base que as assiste e
também os desafios de reconstrução
historiográfica pela ausência de fontes
legislativas compiladas. Naquilo que
é possÃvel pela inteligibilidade diacrônica, buscamos esboçar soluções. No
que, por ora é insuperável, mantivemos como questões abertas, como é
peculiar da cultura medieval. Por
outro lado, no campo do pensamento
que orienta o direito, ao menos nos
albores das universidades, há uma preocupação eminentemente teológico
-moral e filosófica que propriamente
jurÃdica a subsidiar o direito. Por isso,
a escolha dos autores para a análise
decorre da influência e abrangência
acadêmica. Finalmente, procurou-se
atentar para os conjuntos de elementos substanciais e inovadores propiciados pelas expressões de direito verificadas na Idade Média, evitando-se
formulações rÃgidas e categóricas.

The scope of this paper is to
scrutinize the existence of guidelines
and special sense into various forms of
law or rules of the Middle Ages. There
are special challenges in the analysis to
overcome: the lack of a univocal and
homogeneous system of law along the
lines emerging in the modern period,
the extension of the so-called middle
age, the variety of legal expressions
coexisting in each period and the basic
philosophy that assists them and also
the challenges of historiographical
reconstruction by the absence of the
compiled legislative sources. What is
possible by diachronic intelligibility,
we seek to outline solutions. What for
now it is insuperable, we kept as open
questions, such as it is peculiar of medieval culture. On the other hand,
in the field of thought that guides
the right, at least at the dawn of the
universities, there is an eminently
theological, moral, and philosophical concern than strictly legal right to
subsidize. Therefore, the choice of authors for the analysis results from their
influence and academic scope. Finally, we tried to pay attention to the sets
of elements enabled by substantial and
innovative expressions of law found in
the Middle Ages, avoiding rigid and
categorical formulations.
