A investigação em tela pretende demonstrar que a população carcerária brasileira vem aumentando substancialmente durante os últimos anos, especialmente em relação as mulheres, por serem as mais atingidas pela Lei 11.343/06, a nova Lei de Drogas. Assim, busca-se elencar os principais motivos que as levam a adentrar no tráfico de drogas, bem como analisar seu perfil sociodemográfico e entender de que forma atuam nesse comércio ilegal. Além disso, será exposta uma breve análise crítica acerca da Lei de Drogas, notadamente em virtude da seletividade penal imbricada em suas disposições. Por fim, investiga-se também as condições das unidades prisionais em relação a sua infraestrutura e nota-se que ela é inapropriada para o corpo feminino, pois ele possui diversas especificidades amparadas por tratados internacionais de direitos humanos e princípios constitucionais. Para atingir o objetivo almejado, a metodologia de pesquisa fundamenta-se na revisão de tipo bibliográfica e documental de caráter qualitativo, desenvolvida mediante o levantamento de livros, artigos científicos e documentos que versam acerca do tema, bem como através da análise de tratados internacionais de direitos humanos e da Constituição da República de 1988.
This research aims to demonstrate that the Brazilian prison population has increased substantially in recent years, especially among women, as they are the most affected by Law 11.343/06, the new Drug Law. Thus, it seeks to identify the main reasons that lead women to engage in drug trafficking, as well as to analyze their sociodemographic profile and understand how they operate in this illegal trade. Furthermore, it provides a brief critical analysis of the Drug Law, notably due to the selective penalization inherent in its provisions. Finally, it also investigates the infrastructure conditions of prison units, noting that it is unsuitable for the female body, as it has several specific characteristics protected by international human rights treaties and constitutional principles. To achieve the desired objective, the research methodology is based on a qualitative bibliographic and documentary review, developed through the survey of books, scientific articles and documents that deal with the topic, as well as through the analysis of international human rights treaties and the 1988 Constitution of the Republic.
