O presente artigo, elaborado a partir de pesquisa legal, doutrinária e jurisprudencial, objetiva analisar, com um viés crítico, o princípio constitucional do acesso à Justiça, seu conceito, histórico, evolução legislativa e formas de aplicação, principalmente pela via da solução alternativa de controvérsias. Será tratado também o tema da possibilidade (ou não) da utilização de precedentes estrangeiros pela Justiça constitucional, à luz da atual jurisprudência do Supremo Tribunal Federal, bem como se tal utilização tem sido feita de maneira consistente e eficaz pela Suprema Corte, mormente para o fim de garantir o acesso à Justiça.

This article, based on a legal, doctrinal and jurisprudential research, aims to analyze, with a critical bias, the constitutional principle of access to Justice, its concept, history, legislative evolution and forms of application, alternative of controversies. The issue of the possibility (or otherwise) of the use of foreign precedents by constitutional courts will also be discussed in light of the current jurisprudence of the Federal Supreme Court, as well as whether such use has been consistently and effectively exercised by the Supreme Court especially in order to guarantee access to Justice.
