O objetivo deste estudo é analisar o livro Helena, de Machado de Assis, a partir da História do Direito, com foco no Direito praticado durante o Segundo Reinado. Dessa forma, neste trabalho procurou-se realizar uma revisão de literatura da obra Helena de Machado de Assis com o objetivo de observar o fato de que a legislação da época não oferecia amparo jurídico às mulheres, como acontecia como sistema de herança durante o período histórico e entender as primeiras ações legais para o fim da escravidão. Consequentemente, para se alcançar esse objetivo, o método utilizado é o histórico com abordagem qualitativa, através do nível explicativo utilizando a técnica de pesquisa bibliográfica. Os resultados encontrados foram que no segundo reinado as mulheres eram desassistidas em relação à garantia de seus direitos, havendo um cerceamento dos mesmos, representado durante a narrativa do livro em que as personagens femininas, principalmente Helena, estão subordinadas a um sistema patriarcal no qual a herança é passada somente para os homens, e em que as mulheres ficam restringidas apenas as atividades domésticas. Porém, em algumas partes do texto é possível observar que a personagem principal e o narrador, questionam, mesmo que sutilmente, a situação em que a personagem se encontra, e do mesmo modo realiza menções a questões jurídicas da época.
The goal of this study is to analyze the book Helena, by Machado de Assis, from the History of Law, focusing on the Law practiced during the Second Reign. Works of classical literature can reveal the legal phenomena that took place at the time the text was written. Therefore, in this work, an attempt was made to carry out a literature review of the work Helena by Machado de Assis in order to observe the fact that the legislation of the time did not offer legal protection to women, how the inheritance law happened during the historical period and understand the initial legal proceedings for the end of slavery. Consequently, in order to achieve this objective, the method used is the historical one with a qualitative approach, through the explanatory level using the bibliographical research technique. The results found were that in second reign period women were unassisted in relation to the guarantee of their rights, with a curtailment of the same, represented during the narrative of the book in which the female characters, mainly Helena, are subordinated to a patriarchal system in which inheritance is passed only to men, and women are restricted to domestic activities only. However, in some parts of the text it is possible to observe that the main character and the storyteller questions, even subtly, the situation in which she finds herself, and also refers to the legal issues at the time.
