O artigo 10 da Lei 12.527/2011 (Lei de Acesso à Informação), como condicionante ao exercício do direito de acesso à informação previu a obrigatoriedade da identificação do solicitante da informação. O objetivo do trabalho é analisar de que modo tal exigência acaba colocando em risco o próprio exercício do direito (tanto do ponto de vista da informação quanto do solicitante), as alterações legislativas decorrentes de tal preocupação e possíveis soluções para que não haja o enfraquecimento de tal direito constitucionalmente garantido.

Article 10 of Law 12,527 / 2011 (Law on Access to Information), as a condition for exercising the right of access to information, provided for the obligation of identifying the information requestor. The purpose of this study is to analyze how this requirement endangers the very exercise of the right (both from the point of view of information and the petitioner), the legislative changes resulting from such concern and possible solutions so that there is no weakening of such constitutionally guaranteed right.
