Crimes de natureza sexual têm um procedimento investigatório complexo, sobretudo por se tratar de um delito que acontece “às escuras”. Tem-se, então, a palavra da vítima, em seu depoimento, como uma das mais relevantes modalidades de produção de prova nesse contexto. A problemática que se pretende enfrentar com este trabalho refere-se aos danos que o interrogatório pode causar à vítima, como a revitimização, caso seja realizado de modo a negligenciar a saúde mental e segurança da ofendida, aludindo-se ao “depoimento sem dano” como uma maneira de contribuir com as investigações e, ainda, resguardar a vítima. Para tanto, será feita revisão bibliográfica ancorada à criminologia feminista, bem como ao ramo criminológico da vitimologia, além da realização de pesquisas legislativas e jurisprudenciais, pautando-se principalmente no Recurso Ordinário em Habeas Corpus 45.589/MT e na Lei nº 13.431/2017. Em conclusão, aponta-se que, embora o Direito seja um sistema de violência institucional, são verificados alguns avanços no que tange à humanização da coleta de depoimento da vítima.

Crimes of a sexual nature have a complex investigative procedure, especially as it is a crime that happens hidden. Then, the victim's word, in her testimony, is one of the most relevant modalities of evidence production in this context. Thus, the victim's word, in her brief, is one of the most relevant modalities of evidence production in this context. The problem that this work intends to face refers to the damage that the interrogation can cause to the victim,if carried out in a way that neglects the mental health and safety of the victim, alluding to the practice of “evidence without damage” as a way to contribute with the investigations and, still, protect the victim. Therefore, a bibliographic review based on critical criminology related to gender issues, as well as the criminological branch of victimology, in addition to legislative and jurisprudential research. In conclusion, it is pointed out that, although the Law is a system of institutional violence, there are some advances regarding the humanization of the victim's testimony collection.
