A crise presente do capitalismo, ao mesmo tempo econômica, política e jurídica, também se faz acompanhar de uma crise de suas teorias de apoio, as quais precisam ser encaradas como problema teórico de pesquisa. Para mirar a superação dos atuais padrões de sociabilidade, o objetivo do presente trabalho é sistematizar aqueles horizontes teóricos do campo marxista que buscam se fundar na própria materialidade da reprodução do capital, apontando para suas determinações e suas contradições, revelando o caráter estrutural da crise e o problema político-ideológico da reprodução social. Assim, buscar-se-á anelar uma específica junção de alguns dos campos teóricos marxistas contemporâneos, que floresceram, quase todos, a partir do terço final do século XX. Em destaque, o referencial teórico que unirá tais campos será a crítica do direito promovida por Evguiéni Pachukanis, bem como as contribuições que Althusser construirá para a crítica da ideologia jurídica.

The present crisis of capitalism, at the same time economic, political and juridical, is also accompanied by a crisis of its support theories, which need to be seen as a theoretical problem of research. This work mains to systematize those theoretical horizons of the Marxist field that seek to be founded on the very materiality of the reproduction of capital, pointing to its determinations and their contradictions, revealing the structural character of the crisis and the political-ideological problem of social reproduction. Thus, a specific junction of some of the contemporary Marxist theoretical fields that flourished, almost all, from the last third of the twentieth century will be sought. In the main, the theoretical framework that will link such fields will be the critique of law promoted by Evguiéni Pachukanis, as well as the contributions that Althusser will build for the critique of legal ideology.
