Resumo Português:

Este estudo tem como finalidade avaliar a nova Lei de Migração 13.445/17, bem como seu Decreto regulamentador 9.199/17 com enfoque nas questões referentes à violência relacionada à discriminação sofrida pelos imigrantes, além das questões referentes à criminalização da imigração irregular. O principal enfoque consiste em entender não apenas a nova legislação acerca do tema, mas a importância da mesma. Ainda, visou-se avaliar se houve de fato uma evolução relativa à proteção que a Lei se propõe. Para tanto, buscou-se por meio de um estudo comparado, analisar os avanços e retrocessos atinentes à temática no Brasil. Desse modo, o trabalho acadêmico visa servir de objeto de análises críticas às políticas migratórias, além de avaliar a aplicabilidade das normas no caso concreto.

This study aims to evaluate the new Migration Law 13,445/17 as well as its regulatory decree 9,199/17, focusing on issues related to violence and discrimination suffered by immigrants, as well as the criminalization of irregular immigration. The main focus is to understand, not only a new law on the subject, but also the importance of it. In addition, it was aimed to evaluate the evolution regarding the protection that the Law proposes. To do so, there was stablished a comparative analysis, that allows to evaluate the advances and setbacks related to the theme in Brazil. Therefore, the academic work aims to serve as an object of a critical analysis of the migratory policies, and to evaluate the applicability of the measures in the factual scenario
