Como monumentos da modernidade polÃtica, os Estados Nacionais configuram os sistemas do positivismo jurÃdico. O discurso polÃtico no final do século XX gira em torno da confiabilidade dos ordenamentos jurÃdicos estatais. O presente texto enfoca a decomposição do Estado Nacional sob o prisma da obrigatoriedade que vincula o comportamento dos cidadãos à ordem legal vigente. O artigo desenvolve as conexões entre direito e dever no âmbito dos modernos sistemas jurÃdicos. À luz da doutrina kantiana do direito, o trabalho advoga a favor do caráter normativo da obrigação jurÃdica.
As monuments of political modernity, national States configure the systems of juridical positivism. The political discourse at the end of the 20th Century revolves around the reliability of the State’s juridical ordering. The present text focuses on the decomposition of the national State from the perspective of the obligatoriness that links citizen’s behavior to the legal order. The article develops the relations that connect right and duty within the sphere of modern juridical systems. Under the light of the Kantian doctrine of right, the present paper advocates the normative character of juridical obligation.
