O presente artigo pretende analisar a possibilidade ou a impossibilidade de que os empregados pertencentes às categorias que trabalham em atividades essenciais – notadamente aqueles da área da saúde – façam greve em períodos de calamidade pública decorrentes de pandemia. Para tanto, faz análise sobre a greve e seus limites legais, para posteriormente tratar das atividades tidas como essenciais pela lei e cuidar dos limites especiais que são impostos aos empregados que nelas laboram. Em conclusão, propõe que, considerado o período muito excepcional que impõe dificuldades a toda a sociedade, a possibilidade de realização de greve é quase inexistente, excepcionando-se o caso de greve ambiental, hipótese na qual a greve é possível.
This paper intends to analize the possibility or impossibility of employes who work in categories considered essential - notably those who work as health workers - to strike in periods of public calamity due a pandemic. For this purpose, it analyzes the strike and its legal limits, to subsequently talk about the activities considered essential by the law and to analyze the special limits that are imposed to employees. In conclusion, this paper proposes that, considering the very exceptional period that imposes difficulties on the whole society, the possibility of a strike is almost non-existent, with the exception of the case of an environmental strike, in which case the strike seems possible.
