O artigo objetiva tratar da noção de propriedade segundo o Realismo JurÃdico
Clássico, baseado no pensamento do Aquinate. Para este autor, o direito de
propriedade possui um caráter objetivo e tem em si uma função social
inseparável. A concepção moderna acerca do Direito e da propriedade
promoveu uma modificação naquela visão, causando a percepção da
propriedade como algo absoluto. O inconveniente dessa percepção foi um
pouco mitigado pela construção da noção moderna de função social, mas a
melhor solução seria o retorno à percepção clássica sobre a matéria.
The paper intends to treat on the notion of property as understood by the
Classical Juridical Realism, based on the Aquina’s thought. To this author, the
right of property has an objective character and an inseparable social function
in itself. The modern conception about the Law and the property promoted a
modification on that view, causing a perception of the property as something
absolute. The inconvenient of this perception was a little reduced by the
modern notion of the social function, but the best solution would be the return
to the classical perception of the matter.
