A problemática do abuso de autoridade no cenário nacional foi objeto de análise, através de seus Projetos de Lei do Senado, especificamente sobre o tema da prisão preventiva, em paralelo com a Teoria da Argumentação Jurídica de Robert Alexy. Através desta buscou-se a operacionalidade do discurso racional como contraste ao crime de abuso de autoridade, no que tange a eficácia dos projetos. Juntamente com a análise da aplicação do instituto da Prisão Preventiva verificou-se possível o uso da Teoria da Argumentação Jurídica de Alexy como meio de legitimar o exercício da autoridade, afastando o abuso desta. Usou-se no desenvolvimento deste trabalho a metodologia teórico-descritiva.
Resumo Inglês:
The problem about the abuse of authority on national scenario was object form an analysis through the Senate’s law projects specifically about the subject of pre-trial detention, comparing with the Theory of Legal Argumentation which looks for the operability from the rational speech. Herewith the analysis of application of pre-trial detention institute was observed that the use of the Theory of Legal Argumentation by Alexy is a way to legitimize the exercise of authority avoiding his abuse. Was used on development of this work the theoretic-descriptive methodology.
