Este ensaio teórico trata de estudos sobre reforma constitucional que possibilitou a implementação da governança colaborativa no sistema judiciário brasileiro, onde a hierarquia cede lugar à “colaborarquia”. O problema medular discute como o sistema judiciário brasileiro irá aplicar a governança colaborativa fazendo cumprir, in totum, os princípios contidos no art. 37 da Constituição Federal. Os objetivos são os de conhecer elementos teóricos sólidos sobre governança além de pesquisar um modelo organizacional aplicável ao Judiciário. A metodologia foi bibliográfica e exploratória. Encontrou-se o caminho de como o Judiciário pretende implantar a nova governança a partir da Resolução 221/2016 do CNJ.
This theoretical essay deals with studies on constitutional reform that allowed the implementation of collaborative governance in the Brazilian judiciary system, where the hierarchy gives way to “colaborarquia”. The main problem discusses how the Brazilian judicial system will apply collaborative governance by enforcing, in totum, the principles contained in article 37 of the Federal Constitution. The goals are to know about solid governance elements, beyond researching an organizational model applicable to the judiciary. The methodology was bibliographical and exploratory. It was found ways of how the judiciary intends to implement the new governance based on Resolution 221/2016 of the CNJ.
