O presente artigo tem como tema a possibilidade ou não de uma reforma política através de uma Assembleia Nacional Exclusiva, instaurada por meio de emenda à Constituição, referendada por voto popular, com atuação em paralelo ao Congresso Nacional, em razão da crise de legitimidade e confiança que as instituições democráticas estão insertas. O estudo perpassa pela compreensão das vedações existentes de alteração das Constituição Federal, e quais são os procedimentos existentes para tanto. Também, contextualiza o cenário político atual da República, desaguando na necessidade de o Direito reconhecer as necessidades extraordinárias imprevisíveis como meio para evitar a ruptura de todo o sistema. Por fim, adota que é possível a realização de uma reforma constitucional exclusiva, através de uma Assembleia Nacional Exclusiva, propondo redação à emenda constitucional para tanto.

This article is related to whether possibility or not of the political reform through a National Exclusive Assembly, established by means of an amendment to the Constitution countersigned by popular vote with National Congress parallel activities, due to the legitimacy crisis and belief that democratic institutions are uncertain. The research passes through the comprehension of the existing fences of alteration of the Federal Constitution, and which are the available procedures for that. In addition, it also contextualizes the current political scenario of the Republic, flowing into the necessity of the Justice recognizes the unforeseeable extraordinary needs as a mean of avoiding the rupture of the entire system. Lastly, it embraces that the implementation of an exclusive constitutional reform is feasible, by means of a National Exclusive Assembly, proposing redaction to the constitutional amendment to achieve the aim.
