Este artigo apresenta o resultado de uma revisão bibliográfica sobre regularização fundiária no Brasil, com ênfase nas áreas de interesse social. O objetivo foi buscar informações atualizadas sobre os instrumentos disponíveis na legislação. Esta pesquisa está vinculada ao Projeto Universidade Bairro do ISECENSA em Campos dos Goytacazes – RJ. Quanto ao método de pesquisa, procurou-se levantar material teórico e legislação referente ao tema, destacando os principais instrumentos jurídicos. Conseguiu-se estudar os principais instrumentos e a legislação recente sobre regularização fundiária no Brasil. Também foram citados exemplos de regularização realizados em algumas cidades. Pôde-se concluir que a política de regularização fundiária tem, a cada dia, se consolidado, com novas leis e instrumentos que têm buscado agilizar um processo de regularização que ainda considerado demorado. Esta política avança em sua intenção, mas convive com uma incógnita, a de não incentivar a proliferação de novas ocupações irregulares. A falta de moradia no Brasil deve ser combatida com a regularização fundiária de forma sustentável e com outros programas para a geração de novas moradias. Não se pode deixar de lado a utilização do planejamento em todas as suas etapas, especialmente a fiscalização, para que a cidade possa cumprir sua função social, propiciando qualidade de vida para a população.

This article presents the result of a bibliography review on land regularization in Brazil, with emphasis on
areas of social interest. The object was to find updated informations about the instruments available in the
legislation. This research is linked to the Project of the Neighborhood University ISECENSA in Campos -
RJ. About the method of research, looked for to raise the theoretical material and legislation referring to the
theme, highlighting the main legal instruments. It was succeeded to study the main instruments and recent
legislation on land regularization in Brazil. They were also cited examples of regularization carried out in
some cities. It was concluded that the politic of land regularization has, every day, if consolidated, with new
laws and instruments that have sought to expedite a process of regularization, which is considered slow. This
politic goes into its intention, but living with an incognita, not to encourage the proliferation of new irregular
occupations. The housing shortage in Brazil must be fought with the regulation in a sustainable manner and
with other programs for the generation of new housing. It can not leave aside the use of planning in all its
stages, particularly the surveillance, so that the city can fulfill its social function, providing quality of living
for the population.
