Partindo da Constituição Federal de 1988 que traz em seu Título II, Capítulo I os Direitos e as Garantias Individuais e Coletivas. “Art. 5º Todos são iguais perante a lei, sem distinção de qualquer natureza [...] I - homens e mulheres são iguais em direitos e obrigações, nos termos desta Constituição” (BRASIL, 1988, p.8), esse artigo pretende analisar a trajetória da mulher na sociedade com foco na mulher presidiária. E também analisar a desigualdade entre homens e mulheres, não só dentro do sistema penitenciário, mas também, e principalmente, entre as oportunidades de reinserção destas mulheres no mercado de trabalho, após o cumprimento de suas penas. E, a partir dessa análise, tentar avaliar o quão utópico, ou não, é a ressocialização de um egresso do sistema penitenciário, bem como a igualdade entre homens e mulheres.
Starting from the Federal Constitution of 1988 that includes in its Title II, Chapter I the Individual and Collective Rights and Guarantees. “Art. 5. Everyone is equal before the law, without distinction of any kind (BRASIL, 1988, p.8) I - men and women are equal in rights and obligations, under the terms of this Constitution”, this article intends to analyze the women trajectory in society with a focus on female inmates. Also, analyze the inequality between men and women, not only within the penitentiary system, but also, and especially, among the opportunities for reintegration of these women in the labor market after the fulfillment of their sentences. From this analysis try to evaluate how utopian, or not, is the resocialization of an egress from the penitentiary system, as well as equality between men and women.
