O presente texto pretende compreender as relações entre Sociedade e Constituição a partir de três modelos teóricos desenvolvidos principalmente em torno de pesquisas na Universidade Federal de Minas Gerais (UFMG) e que dialogam entre si. Tais pesquisas se iniciaram com Menelick de Carvalho Netto e se desdobraram para os professores Marcelo Cattoni e David Gomes. Passaremos, portanto, pelos principais pontos das teorias desenvolvidas por cada autor, evidenciando os pontos em comum e as diferenças entre eles, para assim entender como suas ideias dialogam e procurar compreender definições de Modernidade, Constituição moderna e, principalmente, as relações da Constituição com a Sociedade e seus pontos de tensão. Por fim, compreenderemos de que maneira a reconstrução dessa base teórica é essencial para a defesa da democracia brasileira em um momento de crise institucional.
The present paper aims to understand the interrelation between Society and Constitution based on three theoretical models developed around research at the Federal University of Minas Gerais (UFMG) that dialogue with each other. This research began with Menelick de Carvalho Netto and unfolded for professors Marcelo Cattoni and David Gomes. We will, therefore, go through the main points of the theories developed by each author, highlighting the commonalities and differences between them, in order to understand how their ideas dialogue and seek to understand definitions of Modernity, modern Constitution and, especially, the relations of the Constitution with Society and its points of tension. Finally, we will understand how the reconstruction of this theoretical foundation is essential for the defense of Brazilian democracy in a moment of institutional crisis.
