Este trabalho se propõe a analisar os acontecimentos de agosto de 1961, defl agrados pela inesperada renúncia do então presidente Jânio Qu adros, sob a perspectiva de uma crise constitucional. Inicialmente, será exposto o cenário histórico-político da época, marcado pela controvertida posse de seu vice, João Goulart, e pela crise da legalidade. Com o objetivo de analisar a repercussão constitucional resultante dessa crise política, será analisado o conceito de “crise constitucional”, e demonstrar-se-á que houve uma crise desse tipo no contexto histórico explorado. Para tanto, foram utilizados documentos do período, como Anais da Câmara dos Deputados e Diários do Congresso Nacional, e bibliografia complementar.
This paper aims to analyse the events of August, 1961, triggered by the unexpected resignation of the then President Jânio Quadros, under the perspective of a constitutional crisis. Firstly, the historical and political background of that time, characterized by the controverted inauguration of the then Vice-President, João Goulart, and by the legality crisis, will be exposed. In order to analyse the constitutional repercussion resulting from this political crisis, the concept of “constitutional crisis” will be examined, for, then, demonstrate that it has effectively occurred in the explored historical context. Therefore, documents, such as Annals of the Chamber of Deputies and Diaries of the National Congress from that time, and complementary bibliography were used.
