Tem como propósito esclarecer o que é reconhecido, na época presente brasileira, como embaraço no acesso igualitário à saúde, em contraste com a pujança dos dispositivos constitucionais que dispõe sobre o referido direito em sua conexão essencial com o princípio da dignidade da pessoa humana, concebido como o pilar axiológico básico do Estado Democrático de Direito, por meio da utilização de uma metodologia crítico-dialética que busca uma reflexão situada mais no âmbito das ciências sociais, como, aliás, devem ser investigados os fenômenos jurídicos/políticos/históricos, considerados em sua concretude. A autora se valeu, em sua pesquisa, de pronunciamentos importantes — em defesa do direito ao acesso igualitário à saúde e contra as posições restritivas ou omissivas sustentadas pela Administração — por parte dos tribunais superiores e, em especial, do Supremo Tribunal Federal. Por contributo final, a autora considera que ainda falta uma mais pujante jurisdição constitucional no sentido preciso de promover a concretização de direitos (sobretudo os fundamentais) por seu caráter marcadamente finalístico e social.
Its purpose is to clarify what is recognized, in the present Brazilian era, as an embarrassment in equal access to health, in contrast to the strength of the constitutional provisions that it provides for in that essential connection with the principle of human dignity, conceived as the basic axiological pillar of the Democratic State of Law, through the use of a critical-dialectical methodology that seeks a reflection situated more within the scope of the social sciences, as, indeed, the legal / political / historical phenomena, considered in its concreteness. In her research, the author made use of important pronouncements - in defense of the right to equal access to health and against the restrictive or omissive positions supported by the Administration - by the higher courts and, in particular, the Supreme Federal Court. As a final contribution, the author considers that there is still a lack of more powerful constitutional jurisdiction in the precise sense of promoting the realization of rights (especially fundamental ones) due to their markedly finalistic and social character.
