Em tempos de pós-positivismo é inevitável constatar que o Direito passa uma transformação, que implica, entre outras coisas, em um aumento da interrelação entre os diversos ramos do conhecimento jurídico, o que simbolicamente vem representado pelo processo irrefreável de constitucionalização do Direito Civil. Assim, progressivamente o Direito Civil vem incorporando valores constitucionais e reduzindo a influência de sua mola mestra, a autonomia da vontade. Esta simbiose atingiu em cheio os tradicionais modelos de admissão da responsabilidade civil, reconhecendo a aplicabilidade do princípio da dignidade da pessoa humana à espécie e, consequentemente, admitindo a existência de novos danos extrapatrimoniais que atingem à pessoa. O presente artigo pretende verificar esta nova dinâmica, com foco especial na análise da existência de danos decorrentes do desrespeito aos direitos políticos passivos de mulheres em razão da atuação de partidos políticos ou coligações. Para atingir tal intento será realizada revisão bibliográfica e exame de decisões judiciais acerca do tema, bem como o uso dos métodos indutivo e hermenêutico-concretizador.

In times of post-positivism it is inevitable to verify that Law passes a transformation, that implicates, among other things, in a increase of the interrelation among the various juridical knowledge fields, which symbolically comes represented by the unrestrainable constitutionalisation process of the civil law. Therefore, progressively the civil law has incorporated constitutional values and reduced the influence of its mainspring, the freedom of will. This symbiosis stroke the traditionals admission models of civil responsibility, recognizing the applicability of the principle of human dignity to the sort and, consequently, admitting the existence of new non-material damages that impact the person. This article intends to verify this new dynamics, with special focus on the analysis of the existence of damages resulting from the disrespect to the women’s passive political rights resulting from the action of political parties or coalitions. To reach such intent, will be carried out a bibliographic review and a examination of judicial decisions about the subject, as well as the use of the inductive and hermeneutic-concretizing methods.
