Em tempos de incertezas e mudanças constantes, a questão dos danos punitivos por lesão aos direitos de personalidade e ao meio ambiente, praticados por grandes corporações, conduz a uma necessidade de repensar os institutos, integrando o ordenamento jurídico pátrio em um contexto global. A presente pesquisa inseriu na investigação as questões inerentes aos direitos de personalidade e direitos humanos, bem como, os institutos da responsabilidade civil e a autonomia da pena civil perante o instituto de danos morais e seus desdobramentos, face à sociedade do século XXI. Neste contexto, buscou-se compreender o direito e seus possíveis novos papéis, em especial no ordenamento jurídico pátrio, apontando alterações necessárias à sua evolução com a finalidade de coibir a reincidência de condutas lesivas por parte das grandes corporações.
Resumo Inglês:
In times of uncertainty and constant changes, the matter of the punitive damages for injury to the personality rights and environment, caused by great corporations, leads to a necessity of representing the institutes, integrating the national legal system in a international context. The presente research insert in the ivertigation the matters inherent to the personality rights and human rights, as well as, the institutes of the civil responsability and the autonomy of the civil penalty before the institute of the moral damage and it's unfoldings, in face of the XXI century society. In this context, sought to comprehend the Law and it's possible new roles, in special in the national legal system, pointing necessary alterations to it's evolution with the finalty of restraining the recurrence of harmful conduct by the great corporations.
