Este artigo tem por objetivo apresentar reflexões a respeito da origem da Retórica e sua interligação com a Argumentação, para demonstrar o vínculo dessas áreas com o Discurso Jurídico. Nesse sentido, serão tomados por referência alguns teóricos, como: Aristóteles (1998 [s.d.]), Perelman & Olbrechts-Tyteca (2005 [1958]), Barilli (1985), Mosca (2005; 2004 [1997]), Reboul (2004 [1998]), Petri (2005 [2000]), Meyer (2007) e Plantin (2008). Desse modo, a fundamentação teórica irá tratar dos seguintes tópicos: a) Primórdios da Retórica; b) Fundamentos: os gêneros, as partes e as provas retóricas; c) Nova Retórica: Teorias da Argumentação - Oradores e Auditórios. Assim, estima-se que este estudo possa contribuir para fomentar e desenvolver a discussão entre os profissionais da área jurídica, com vistas a circunscrever e dimensionar esses termos, como possíveis maneiras conceituar Retórica, Argumentação e Discurso Jurídico.
This article aims to present reflections regarding the origin of rhetoric and its interconnection with argumentation, to demonstrate the link between these areas and the Legal Discourse. In this way, some theorists will be taken by reference, such as Aristoteles (1998 [n.d.]), Perelman & Olbrechts-Tyteca (2005 [1958]), Barilli (1985), Mosca (2005; 2004 [1997]), Reboul (2004 [1998]), Petri (2005 [2000]), Meyer (2007) and Plantin (2008). Thereby, the theoretical background will deal with the following topics: a) The Origin of Rhetoric; b) Foundations: genres, parts and rhetorical evidence; c) New Rhetoric: Theories of Argumentation – Speakers and Audience. Thus, it is estimated that this study can contribute to promote and develop the discussion among law professionals, with a view to circumscribing these terms as possible ways to conceptualize Rhetoric, Argumentation and Legal Discourse.
