Este artigo se propõe a estudar os fatores que levam à adoção de meios adjudicatórios em detrimento da mediação na solução de conflitos em geral e como ocorre a escolha da melhor alternativa de solução de conflitos na administração pública. Com apoio no referencial teórico da economia comportamental que analisa a irracionalidade do comportamento humano baseado nos vieses cognitivos, os quais conduzem a decisões subótimas, na pesquisa bibliográfica e no estudo de casos, aqui é utilizado o método dedutivo, que pretende analisar em que medida os estímulos de comportamento adotados pelo Estado, mediante uma política pública, pode contribuir para melhorar a conduta individual e coletiva na escolha da mediação de seus conflitos.
This article proposes to study the factors that lead to the adoption of adjudicatory means to the detriment of mediation in the solution of conflicts in general and how the choice of the best alternative of conflict resolution in the public administration occurs.
